Terms of Service

1. Agreement to Terms

By accessing or using LeadGizmo's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. LeadGizmo is a service of Lunar Capital REI, LLC, located at 1515 Mockingbird Lane, Suite 420, Charlotte, NC 28209.

2. Description of Services

LeadGizmo provides real estate investment lead generation services. We deliver curated property investment opportunities to subscribers via email and SMS based on their selected subscription plan. Our service covers 11 North Carolina counties and provides leads to help investors identify potential property deals.

3. Subscription Plans

3.1 Available Plans

• Plan A - Property Leads: $79/month
• Plan B - Distressed Properties: $89/month
• Plan C - Estate Properties: $99/month
• Plan D - All Lead Types: $129/month

3.2 Trial Period

All new subscriptions include a 7-day free trial. You may cancel during the trial period without charge. After the trial, your selected plan's monthly fee will be automatically charged to your payment method.

3.3 Delivery Schedule

Leads are delivered twice weekly on Tuesdays and Fridays at 9:00 AM Eastern Time. Delivery schedule may be adjusted with advance notice to subscribers.

4. User Accounts

4.1 Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4.2 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services.

5. Payment Terms

5.1 Billing

Subscriptions are billed monthly in advance. All payments are processed securely through Stripe. You authorize us to charge your payment method on a recurring basis.

5.2 Refunds

Monthly subscription fees are non-refundable except as required by law. If you cancel your subscription, you will continue to have access until the end of your current billing period.

5.3 Price Changes

We reserve the right to modify pricing with 30 days' notice to existing subscribers.

6. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You may not:

• Share or resell leads to third parties
• Use the service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to reverse engineer or copy our service
• Use automated systems to access our service without permission
• Interfere with or disrupt the service or servers

7. Intellectual Property

All content, features, and functionality of LeadGizmo are owned by Lunar Capital REI, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Email and SMS Communications

8.1 Consent

By subscribing, you consent to receive service-related emails and, if opted in, SMS messages. You can manage your communication preferences in your account settings or follow unsubscribe instructions in our messages.

8.2 SMS Terms

If you opt in to SMS alerts:

• Message frequency varies, up to 10 messages per month
• Message and data rates may apply
• Text STOP to cancel, HELP for assistance
• We will not share your phone number with third parties for marketing

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED. INVESTMENT DECISIONS BASED ON OUR LEADS ARE MADE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNAR CAPITAL REI, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Investment Disclaimer

LeadGizmo provides information about potential real estate investment opportunities. We are not investment advisors, and our service does not constitute investment, legal, or financial advice. Always conduct your own due diligence and consult with qualified professionals before making investment decisions.

12. Indemnification

You agree to indemnify and hold harmless Lunar Capital REI, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately.

14. Governing Law

These Terms are governed by the laws of North Carolina, without regard to its conflict of law provisions. Any legal action relating to these Terms shall be brought exclusively in the courts of Mecklenburg County, North Carolina.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through our website. Your continued use after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Communication Policy, constitute the entire agreement between you and LeadGizmo regarding the use of our services.
